Terms and Conditions
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by customers (hereinafter “Customer”) via the online shop at kethewohlfahrt.com. By placing an order, the Customer acknowledges these GTC as the sole basis for the contractual relationship.
2. Contractual Partner, Conclusion of Contract
The sales contract is concluded with the company operating the kethewohlfahrt.com website. The presentation of goods on the website constitutes a non-binding invitation to the Customer to make an offer. By completing the ordering process and clicking the button “Order with Obligation to Pay”, the Customer makes a binding offer to purchase the goods in the shopping cart. The contract is only formed when we send a written order confirmation via email or when the goods are dispatched.
3. Prices and Shipping Costs
All prices are stated in the respective currency on the website and include the statutory value-added tax (VAT). Additional shipping and delivery costs will be indicated separately during the ordering process and are to be borne by the Customer. The payment methods available are listed during the checkout process.
4. Delivery and Shipping
Delivery is made to the delivery address specified by the Customer. The delivery times indicated are approximate and non-binding. We are not liable for delays in delivery caused by force majeure or events beyond our reasonable control. Partial deliveries are permissible.
5. Reservation of Title
The goods remain our property until full payment has been received.
6. Right of Withdrawal for Consumers
Customers who are consumers within the meaning of applicable consumer protection laws have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which the Customer or a third party named by the Customer takes possession of the goods. To exercise the right of withdrawal, the Customer must inform us of their decision to withdraw by means of a clear statement using the contact details provided on our website. The goods must be returned without undue delay and in any event no later than 14 days after the communication of withdrawal. The direct cost of returning the goods shall be borne by the Customer.
7. Warranty and Defects Liability
We provide a warranty for defects in accordance with the applicable statutory provisions. The Customer is requested to check the goods immediately upon receipt. Obvious defects must be reported to us within a reasonable period, preferably via the contact form on our website.
8. Data Protection
The protection of personal data is of utmost importance to us. We collect and process personal data in accordance with the applicable data protection regulations, in particular the General Data Protection Regulation (GDPR). Detailed information can be found in our separate Privacy Policy.
9. Liability
Our liability for damages, irrespective of the legal grounds, is limited to intent and gross negligence. This does not apply to liability for injury to life, body, or health, or under the Product Liability Act.
10. Final Provisions
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. We reserve the right to amend these GTC at any time. The version current at the time of the order shall apply.
